These Terms of Use govern access to and use of NGFProductions.com and the websites, applications, communities, products, services, media, marketplaces, ecommerce experiences, software, technology and other properties owned or operated by Next Generation Fansites LLC, doing business publicly as NGF Productions LLC, including properties operated under current or future assumed names, d/b/a names, brands, domains, trade names or service marks, including CoogsNation.com (collectively, the “NGF Properties”).
For purposes of these Terms, “NGF,” “we,” “our” and “us” mean Next Generation Fansites LLC, including its public operating name NGF Productions LLC. Unless expressly stated otherwise, a d/b/a name, assumed name, brand, domain, website name, trade name or service mark used by Next Generation Fansites LLC identifies a business activity or property of Next Generation Fansites LLC and is not a separate legal entity.
1. Acceptance of Terms
By accessing or using an NGF Property, you agree to these Terms and any property-specific terms, community rules, purchase terms, marketplace terms or policies presented for the feature you use. If you do not agree, do not use the applicable NGF Property. If a property-specific agreement directly conflicts with these Terms, the property-specific agreement controls for that property or feature.
2. Eligibility and Accounts
Public portions of NGF Properties may be viewed without an account unless otherwise stated. Features requiring accounts, purchases, private communications, submissions or other participation may have additional age, eligibility, verification or authorization requirements. You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account, except to the extent applicable law provides otherwise.
3. Acceptable Use
You may not misuse an NGF Property, interfere with its operation or security, attempt unauthorized access, distribute malicious code, impersonate another person deceptively, conduct fraud or unlawful activity, evade technical restrictions, scrape or harvest information in violation of applicable law or our rules, or use an NGF Property in a manner that infringes or misappropriates another person’s rights.
4. User Content and Submissions
Where an NGF Property permits posts, comments, messages, media, listings, reviews, feedback or other submissions, you retain ownership of original content you create. By submitting content to an NGF Property, you grant Next Generation Fansites LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, format, moderate, archive and otherwise process that content as reasonably necessary to operate, secure, improve, administer and promote the applicable NGF Property and its features.
You represent that you have the rights necessary to submit the content and that your submission complies with applicable law, these Terms and any property-specific rules.
5. Next Generation Fansites LLC Intellectual Property
Except for user-owned content and third-party material, NGF Properties and their proprietary elements are owned by or licensed to Next Generation Fansites LLC. This may include copyrights, trademarks, service marks, trade names, assumed names, d/b/a names, logos, domain names, product and feature names, software, source code, databases, compilations, interfaces, designs, graphics, photographs, video, audio, written material, proprietary technology and other intellectual property.
Use of an NGF Property does not transfer ownership of Next Generation Fansites LLC intellectual property. Except as permitted by law or authorized in writing, you may not reproduce, distribute, sell, license, reverse engineer, remove proprietary notices from, or create unauthorized derivative works from protected NGF material.

6. Assumed Names, d/b/a Names, Brands and Properties
Next Generation Fansites LLC may launch, acquire, operate, rename, combine or retire NGF Properties under different assumed names, d/b/a names, brands, domains, trade names or service marks. Unless expressly stated otherwise, those identifiers do not create separate legal entities and the applicable NGF Property remains owned or operated by Next Generation Fansites LLC.
7. Third-Party Intellectual Property and Fan References
Third-party names, logos, trademarks, service marks, copyrighted material and other intellectual property remain the property of their respective owners. References to schools, teams, conferences, leagues, athletes, performers, venues, merchants or other third parties may be used for identification, commentary, news, community discussion, interoperability or other lawful purposes and do not by themselves imply affiliation, sponsorship, licensing or endorsement.
8. Third-Party Services and Integrations
NGF Properties may link to, embed, interoperate with or use third-party services, including ticketing, travel, lodging, transportation, ecommerce, payments, fulfillment, analytics, advertising, social media, AI, media and technology providers. Independent third parties are responsible for their own services, terms, privacy practices, inventory, pricing, availability, transactions and performance.
9. Affiliate, Advertising and Commercial Relationships
Next Generation Fansites LLC may receive commissions, referral fees, advertising payments or other compensation when users view, click, register, purchase or complete qualifying actions through certain links, offers or integrations. Material commercial relationships will be disclosed where required by applicable law. The existence of a commercial relationship does not make an independent merchant, ticketing provider, travel provider or other third party part of Next Generation Fansites LLC.
10. Purchases and Transactions
Where an NGF Property offers purchases, listings, subscriptions or transactions, additional checkout, seller, merchant, shipping, return, refund, payment or marketplace terms may apply. Unless Next Generation Fansites LLC expressly identifies itself as the seller or contracting party, independent third parties are responsible for their products, services and transactions.
11. Privacy and Privacy Choices
Our collection and use of personal information are governed by the Next Generation Fansites LLC Privacy Policy and any property-specific privacy disclosures. NGF Properties may provide a Privacy Choices interface that controls optional analytics, personalization, affiliate-measurement, advertising and marketing technologies. Strictly necessary technologies may remain active where required for security, sessions, fraud prevention, user-requested functions or core operation.
12. Availability and Changes
Next Generation Fansites LLC may add, modify, restrict, suspend or discontinue an NGF Property or feature. We do not guarantee uninterrupted availability, preservation of content, compatibility with every device, or continued availability of any particular feature, vendor or third-party integration.
13. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NGF PROPERTIES AND THEIR CONTENT, FEATURES, LINKS, USER CONTENT, THIRD-PARTY INTEGRATIONS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Next Generation Fansites LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Next Generation Fansites LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO AN NGF PROPERTY.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Next Generation Fansites LLC and its owners, members, managers, officers, employees, contractors and agents from third-party claims, liabilities, damages, losses, costs and reasonable attorneys’ fees arising from your content, misuse of an NGF Property, violation of these Terms, violation of law, or infringement or misappropriation of another person’s rights.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to applicable law and any enforceable property-specific dispute-resolution provision, disputes shall be brought in the appropriate state or federal courts located in Harris County, Texas, unless applicable law requires otherwise.
17. Changes to These Terms
Next Generation Fansites LLC may update these Terms as its business, properties, technology, vendors or legal obligations evolve. The “Last Updated” date identifies the current version. Material changes will be communicated or presented as required by applicable law.
